What is infidelity?

If you are legally married, you and your partner have promised each other eternal marital fidelity and are obliged to uphold it. In the case of infidelity or adultery, one of the partners engages in a long-term affair that breaches this marital fidelity.

According to the old divorce law, one could divorce by mutual consent, on the grounds of a de facto separation of more than 2 years, or on the basis of certain facts such as adultery, assault, or serious insults.

Since the new divorce law (01.09.2007), one can still divorce by mutual consent or on the basis of irreparable breakdown of the marriage. Divorce on the basis of facts no longer exists.

Not only married couples but also legally and de facto cohabiting partners can invoke infidelity or adultery within their relationship as a fault, on the basis of which damages can be claimed.

Is infidelity punishable?

No, infidelity is not punishable in Belgium.

Infidelity is ‘in itself’ no longer a reason for divorce. However, it can still be established to serve as evidence of the irreparable breakdown of a marriage:

“The divorce is pronounced when the court establishes that the marriage is irreparably broken. The marriage is irreparably broken when the continuation of cohabitation between the spouses and its resumption has become reasonably impossible due to that breakdown.” (Civil Code, Art. 229 §1)

The establishment of adultery can also serve to demonstrate ‘gross fault’ on the part of the guilty. A fault on which the divorce can be expedited and whereby the adulterer may lose the right to personal maintenance.

Nonetheless, infidelity continues to have an overwhelming impact on the deceived partner. Emotionally, but often also financially. Because going through a divorce while trying to build a new life? Not so easy.

Is partner tracking legal?

Partner tracking refers to equipping a car with a track-and-trace system or tracking someone’s mobile phone with an application.

Private detectives are not allowed to engage in partner tracking as it violates privacy laws. If a client requests this, we cannot comply.

As a private individual, you are fully allowed to track your own property. There are numerous devices and software available online. However, this technology is originally intended to recover stolen or lost items, not to monitor your partner for infidelity.

We discourage partner tracking as a method of gathering evidence. While you may know where the car or phone is located, what does that reveal about the person? It is not conclusive proof that they were at that location. Concrete visual evidence, on the other hand, is much more reliable.

Can I have my partner checked for cheating?

Yes, that is allowed. Aside from the duty of fidelity within marriage, infidelity, whether inside or outside a marital relationship, can constitute a fault that may lead to compensation.

Can a private investigator officially establish adultery?

Yes, a private detective can make an official determination of infidelity among married partners. However, it remains the responsibility of the client to interpret the evidential value of photos, videos, documents, etc. But an official capture can only be carried out by a bailiff. In such cases, we as detectives do the preparatory work by gathering all the necessary information.
