What is infidelity?

If you are legally married, you and your partner have promised each other eternal marital fidelity and are obliged to uphold it. In the case of infidelity or adultery, one of the partners engages in a long-term affair that breaches this marital fidelity.

According to the old divorce law, one could divorce by mutual consent, on the grounds of a de facto separation of more than 2 years, or on the basis of certain facts such as adultery, assault, or serious insults.

Since the new divorce law (01.09.2007), one can still divorce by mutual consent or on the basis of irreparable breakdown of the marriage. Divorce on the basis of facts no longer exists.

Not only married couples but also legally and de facto cohabiting partners can invoke infidelity or adultery within their relationship as a fault, on the basis of which damages can be claimed.

Is infidelity punishable?

No, infidelity is not punishable in Belgium.

Infidelity is ‘in itself’ no longer a reason for divorce. However, it can still be established to serve as evidence of the irreparable breakdown of a marriage:

“The divorce is pronounced when the court establishes that the marriage is irreparably broken. The marriage is irreparably broken when the continuation of cohabitation between the spouses and its resumption has become reasonably impossible due to that breakdown.” (Civil Code, Art. 229 §1)

The establishment of adultery can also serve to demonstrate ‘gross fault’ on the part of the guilty. A fault on which the divorce can be expedited and whereby the adulterer may lose the right to personal maintenance.

Nonetheless, infidelity continues to have an overwhelming impact on the deceived partner. Emotionally, but often also financially. Because going through a divorce while trying to build a new life? Not so easy.
