Private Investigator for Infidelity
Hire a private investigator for infidelity?
We ensure you can sleep peacefully again:
- You suspect that your partner is cheating on you and want to get rid of that uncertainty.
- You already know that your partner is cheating but need official proof.
- Your ex-partner denies cohabiting again and refuses to revise the financial arrangements.
Buytaert & Partners makes every effort to dispel your last doubts and provides immediately applicable and legally usable proof.
What is infidelity?
If you are legally married, you and your partner have promised each other eternal marital fidelity and are obliged to uphold it. In the case of infidelity or adultery, one of the partners engages in a long-term affair that breaches this marital fidelity.
According to the old divorce law, one could divorce by mutual consent, on the grounds of a de facto separation of more than 2 years, or on the basis of certain facts such as adultery, assault, or serious insults.
Since the new divorce law (01.09.2007), one can still divorce by mutual consent or on the basis of irreparable breakdown of the marriage. Divorce on the basis of facts no longer exists.
Not only married couples but also legally and de facto cohabiting partners can invoke infidelity or adultery within their relationship as a fault, on the basis of which damages can be claimed.
Is infidelity punishable?
No, infidelity is not punishable in Belgium.
Infidelity is ‘in itself’ no longer a reason for divorce. However, it can still be established to serve as evidence of the irreparable breakdown of a marriage:
“The divorce is pronounced when the court establishes that the marriage is irreparably broken. The marriage is irreparably broken when the continuation of cohabitation between the spouses and its resumption has become reasonably impossible due to that breakdown.” (Civil Code, Art. 229 §1)
The establishment of adultery can also serve to demonstrate ‘gross fault’ on the part of the guilty. A fault on which the divorce can be expedited and whereby the adulterer may lose the right to personal maintenance.
Nonetheless, infidelity continues to have an overwhelming impact on the deceived partner. Emotionally, but often also financially. Because going through a divorce while trying to build a new life? Not so easy.
Why hire a private investigator for infidelity?
Have you already done your own investigation? Then you know how time-consuming and nerve-wracking this can be. Moreover, as a private individual, you have, unfortunately, less influence in court.
And what if your investigation goes wrong? Your (ex-)partner finds you out, or you have involved others in this emotionally charged tangle? Save yourself the headaches and potential acts of revenge.
The private investigators of Buytaert & Partners are professionals who discreetly and accurately gather evidence of infidelity. We provide legally usable material and, above all, your peace of mind.
If you are deceived and also financially less strong, you benefit greatly from a private investigator who provides usable evidence of infidelity. This way, you can claim what you are entitled to.
Investigation of infidelity: what and how?
Intake interview
Our private detective first listens to your story completely free of obligation. Together with you (and your lawyer), we will determine how Buytaert & Partners can be of service to you. After this conversation, you decide whether you will proceed with us. Tip: If you have not yet appointed a lawyer, it may be worthwhile to do so at this point.
Investigation into infidelity
To establish suspected infidelity, the private detective organizes observations & surveillances. He or she uncovers the actions and whereabouts of your (ex-)partner, makes independent findings, and records them in a legal report.
Case without catching in the act
In a case without official catching in the act, it is up to the client to deem the detective’s findings of infidelity sufficient. You will know with certainty who the lover is, where your partner has been hanging out with him or her, when, and for how long.
Case with catching in the act
An official catching in the act can only be carried out by the bailiff and with the court’s permission via the so-called “order.” In such a case, our investigation serves as a preliminary investigation. We collect all accurate information regarding addresses and time usage, upon which the bailiff can successfully complete his crucial task.
End of assignment
When the investigation into infidelity is completed depends on the circumstances. Sometimes the private detective gathers sufficient evidence in just one day, while at other times multiple days are needed. Immediate success cannot be guaranteed, but we do make a commitment to effort. As a client, you remain closely involved in the investigation.

What does a private detective uncovering infidelity yield?
An anonymous selection from our cases …
CASE 1
A client of ours co-owned an apartment by the sea with her husband. Her husband often went there “alone” on weekends, while our client was almost 100% sure he had a mistress. Our private detective initiated an investigation into infidelity and was able to officially confirm the suspicions in a legal report. This was enough for our client to take further legal action.
CASE 2
A couple had divorced by mutual consent. The man had always been the breadwinner, and in the divorce agreement, alimony was provided for the woman and the children. After a year, the woman found a new love and unofficially started living together. Officially, she still lived alone. After our intervention, the truth was uncovered, namely that the woman was ‘living together to save costs’. As a result, the man could officially reduce the alimony amount.
CASE 3
A man had not been able to sleep for months because he was very worried that his wife was cheating. He hired Buytaert & Partners to observe and follow his partner. What turned out? His suspicions were unfounded. This shows that an investigation into infidelity can also end positively. The most important thing was that the man was able to sleep soundly again.
Frequently Asked Questions about Infidelity Investigation
Is partner tracking legal?
Partner tracking refers to equipping a car with a track-and-trace system or tracking someone’s mobile phone with an application.
Private detectives are not allowed to engage in partner tracking as it violates privacy laws. If a client requests this, we cannot comply.
As a private individual, you are fully allowed to track your own property. There are numerous devices and software available online. However, this technology is originally intended to recover stolen or lost items, not to monitor your partner for infidelity.
We discourage partner tracking as a method of gathering evidence. While you may know where the car or phone is located, what does that reveal about the person? It is not conclusive proof that they were at that location. Concrete visual evidence, on the other hand, is much more reliable.
